The judges start work in the Constitution Tribunal after they swear an oath in front of the president. It&#39;s a constitutional requirement. Those judges have not. End of story.<br><br>An attempt by one of those judges to usurp the leadership of the tribunal on Friday afternoon when the president is half way to Senegal is 100% illegal. <br><br>Furthermore the &quot;law&quot; that pseudo judge used to try and usurp leadership doesn&#39;t apply to the constitution tribunal. It is a law that applies to common courts. The Constitution Tribunal operates based on Constitution alone and no &quot;common court&quot; laws apply to it. <br><br>The head of the high court and the administrative high court are of the same opinions that this pseudo judge broke the law. <br><br>The whole point of the law to choose those judges (parliament votes for, president takes the oath) is for the judges to be acceptable to both sides. But Donald Tusk has claimed a number of sitting judges were &quot;illegal&quot; (despite them being both voted and sworn which is the condition of becoming a TK judge) so now if he simply provides replacements he has to accept their authority.<br><br>So to avoid this he got his party to not nominate new judges over 1.5 years when they were supposed to do this and now they are trying to nominate a large group all at once which breaks the rule those judges have to be independent. Not a whole group.<br><br>So I&#39;m with the president to decline to swear them in.<br><br>Also for those interested in why Donald Tusk claims tjose judges were illegal. In 2015 when Donald Tusk&#39;s party lost the elections they were entitled to nominate 3 TK judges. Instead they nominated 5 despite their time being up after the end of their parliament. The president refused to swear all 5, because he considered the whole act illegal. They were supposed to nominate 3 they nominated 5. So which 3 do we keep and which 2 do we get rid of?<br><br>Let us not forget this whole mess was started by Donald Tusk. It was planned as a trap for the new government. Now that Tusk returned to power he fell into his own trap.<br><br>It is Donald Tusk&#39;s stupid machinations in 2015 and nominating 5 judges when they were supposed to nominate 3 that continously deprive us, citizens of Poland, of our Constitutional Tribunal that has not heard a case in years because of it.

How can we as Poles support Ukraine when they decided to praise war criminal who committed genocide on Poles in Volhynia? We opened borders, send help and logistics when germans stood and watched and that&#39;s how they thank us.. by glorifying nazism.. I&#39;m done with support.
