Fox spending eight minutes explaining why one federal judge should not have the last word is actually a pretty useful principle. Appeal the ruling, examine the law, let higher courts review it, and eventually find out whether the governments argument survives judicial scrutiny. Fine. Now somebody please carry that enthusiasm down the hallway to Judge Emmet Sullivan. He is dealing with a very different case, but the basic principle of judicial scrutiny should travel remarkably well. The dispute there involves handwritten FBI interview notes underlying four FD 302 reports that reference Trump and contain deeply disturbing, still unproven allegations. The DOJ says the handwritten material is substantially duplicative. Katie Phang is essentially saying, fine, let the judge look at it privately and determine that himself. That sounds suspiciously like the judicial review everybody on this panel suddenly loves. And imagine Sullivan eventually sees those notes. Imagine they are materially different from the FD 302s already released. Then imagine independent evidence eventually corroborates the disturbing allegations recorded in them. Would Fox still spend eight minutes celebrating courts, appeals, evidence, transparency, protecting victims, and letting the legal process reach wherever the facts lead. Or would judicial review suddenly become one of those complicated constitutional principles best discussed immediately after the commercial break. You do not have to believe the allegations to want the evidence examined. That is literally why we have courts. The fascinating question is whether everybody still loves the referee after the referee starts reviewing their side of the field.

Nobody is forcing girls or women to play on the team. If a woman athlete decides to undress in front of men athletes, she has no morals anyway. Nobody is forcing her to give up her morals and modesty. Modesty is more important than playing sports. Sports isn't the only thing a woman can do.
